29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from caveins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section except when: (i) Excavations are made entirely in stable rock; or (ii) Excavations are less than 5 feet in depth and examination of the ground by a competent person provides no indication of a potential cavein: a) Two employees worked in an unshored trench for two days; employees were exposed to excavation collapse hazard and falling rocks; trench was 5.5 ft deep. The dirt trench wall collapsed, burying one employee up to his waist under dirt and a piece of cement debris.
