This condition exposed employees to chemical exposures associated with hazardous chemicals present in the workplace.

29 CFR 1910.1200(h)(1): Employers shall provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new physical or health hazard the employees have not previously been trained about is introduced into their work area. Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and material safety data sheets. a) Birdon America, Inc. @ 4965 Kingston Street, Denver CO 80239: On or before January 14th 2015, the employer did not ensure that employees receive training regarding health and safety hazards of chemicals that they are exposed to during routine job duties. Employees are exposed to metal fumes, compressed gasses, flammable oils, solvents, and volatile organic compounds (VOCs). Chemicals used in the workplace include but are not limited to: Acetone, Rust-Veto (Trimethylbenzene) and Tectyl 185G Black (Hydrocarbons). This condition exposed employees to respiratory, skin and eye irritation hazards.

29 CFR 1910.1200(j)(1): Employers shall train employees regarding the new label elements and safety data sheets format by December 1, 2013. a) Birdon America, Inc. @ 4965 Kingston Street, Denver CO 80239: On or before January 14th 2015, the employer did not ensure that employees receive Hazard Communication training in accordance with Global Harmonized System (GHS) requirements. This condition exposed employees to chemical hazards due to not understanding the GHS pictogram instructions on chemical labels and data sheets.

29 CFR 1910.134(d)(1)(iii): The employer shall identify and evaluate the respiratory hazard(s) in the workplace; this evaluation shall include a reasonable estimate of employee exposures to respiratory hazard(s) and an identification of the contaminant's chemical state and physical form. Where the employer cannot identify or reasonably estimate the employee exposure, the employer shall consider the atmosphere to be IDLH. a) Birdon America, Inc. @ 4965 Kingston Street, Denver CO 80239: On or before January 14th 2015, the employer did not perform an exposure assessment to determine if respirators are required for welding operations. This condition potentially exposed employees to toxic levels of Aluminum. Sampling performed by OSHA inspector on February 3rd, 2014 determined that aluminum fume exposures were below OSHA Permissible Exposure Level (PEL) of 5mg/m3.
