29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. (a) Rivas Roofing@ 4260 S Cimarron Way, Aurora CO 80014: On and before June 12th 2015, the employer did not ensure employees installing new shingles on a 4 in 12 pitch roof were using fall protection. Approximately seven employees were working without the use of fall protection. This condition exposed employees to a fall hazard of approximately 25 feet.

29 CFR 1926.503(a)(2): The employer did not assure that each employee exposed to fall hazards was trained by a competent person qualified in the areas specified in 29 CFR 1926.503 (a)(2)(i) through (viii) (a) Rivas Roofing@ 4260 S Cimarron Way, Aurora CO 80014: On and before June 12th 2015, the employer did not ensure that all employees received fall protection training in accordance with 29 CFR 1926.503(a)(2). This condition exposed employees to a fall hazards while working at heights above 6 feet or more. Abatement Note: A training program should include the following at a minimum: (i): The nature of fall hazards in the work area; (ii): The correct procedures for erecting, maintaining, disassembling, and inspecting the fall protection systems to be used; (iii): The use and operation of guardrail systems, personal fall arrest systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used; (iv): The role of each employee in the safety monitoring system when this system is used; (v): The limitations on the use of mechanical equipment during the performance of roofing work on low-sloped roofs; (vi): The correct procedures for the handling and storage of equipment and materials and the erection of overhead protection; and (vii): The role of employees in fall protection plans; (viii): The standards contained in this subpart.
