29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets: (a) On or about June 24, 2015, Mountain Country Builders Inc., as controlling employer, did not ensure that an employee of Valera's Construction LLC, subcontractor, working below a pump jack scaffold with a worker on it, was protected from overhead falling object hazards in that the employee was not wearing a hardhat. Abatement Note: Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section: (a) On or about June 24, 2015, Mountain Country Builders Inc., as controlling employer, did not ensure that an employee of Valera's Construction LLC, subcontractor, was protected from fall hazards while working on a pump jack scaffold that had its work platform raised 14 feet above the ground. The scaffold did not have guard rails and the worker had no other method of fall protection. Abatement Note: Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").
