29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE): i On or about June 16, 2015; in the warehouse and outside in the yard, the employer allowed employees to wear tennis shoes in the aforementioned areas while performing tasks such as pulling, pushing, lifting and moving an assortment of plastic, metal and iron objects; thus indicating that a hazard assessment was not conducted for struck-by hazards and hazards of uneven terrain.

29 CFR 1910.136(a): General requirements. The employer shall ensure that each affected employee uses protective footwear when working in areas where there is a danger of foot injuries due to falling or rolling objects, or objects piercing the sole. On or about June 16, 2015; in the warehouse and outside in the yard, the employer allowed his employees performing a series of tasks such as pulling, pushing, lifting and moving an assortment of plastic, metal and iron objects to wear tennis shoes, thus exposing employees to potential feet and ankle injuries such as punctures and fractures.
