OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to crushing injuries and amputation hazards during periodic cleaning/sanitation of plant equipment: a) Plant, Nestle Room - On or about 06/30/15 and at times prior thereto employees conducted periodic cleaning/ sanitation of the Weiler M12900A blender units #1 and #2. The equipment was powered, in movement during stages of the cleaning process. the meat sample ports were disassembled, the augers were removed, and the crushing/shear points at the end of the barrels were exposed. the employer did not protect workers from amputations by placing alternative guards at the barrel openings, by guarding by distance, by installing a barrier to control the proximity to the moving parts, or by resorting to any other protective measure. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records. Recommended Abatement Action among other methods, one feasible and acceptable method to correct the hazard above is to follow the recommendations of the U.S. Department f Labor, Occupational Safety and Health Administration, at http://www.osha.gov/SLTC/etools/poultry/sanitationworker.html for implementation of a sequence of steps to maintain the integrity of employee protection by using energy isolation devices, and alternative protection, such as removing workers from the machine area to prevent exposure to machine hazards.

29 CFR 1910.147(c)(7)(i)(A): Authorized employee(s) did not receive training in the recognition of applicable hazardous energy sources, the type and magnitude of the energy available in the workplace, and the methods and means necessary for energy isolation: a) Plant, Protein-Bulk Grind Department (Nestle Room) - On or about 06/30/15 and at times prior thereto employees conducted periodic cleaning/sanitation of equipment including (but not limited to) the Weiler M12900A Mixers, unit #1 and unit#2 (Lockout/tagout procedure #BG009) the Bottom Conveyor (Lockout/tagout procedure #BG010) and the Feed (screw) (Lockout/tagout procedure #BG011). The employer did not train the authorized employees in relation to a) each equipment and the specific associated lockout/tagout procedure, b) the types of energies and the specific procedural steps for shutting down, isolating, blocking and securing the equipment to control hazardous energy, c) the specific procedural steps for the placement, removal and transfer of lockout devices or tagout devices and the responsibility for them, and d) the specific requirements for testing the equipment to determine and verify the effectiveness of lockout devices, tagout devices, and other energy control measures. Workers were exposed to crushes/amputations. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. Locks were not applied when required during the sanitation operations. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.
