29 CFR 1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section:    A). On or about July 1, 2015  an employee of D-Lux Homes was working on a tubular welded scaffold system, two tiers high (approximately 12 feet 8 inches), and was not protected from falling to the ground below by any means of Personal Fall Protection system, or guardrails and mid rails on open sides of the scaffold.

29 CFR 1926.451(b)(1): Each platform on all working levels of scaffolds was not fully planked or decked between the front uprights and the guardrail supports as specified in paragraphs 1926.451(b)(1)(i)-(ii)  A). On or about July 1, 2015, an employee of D-Lux Homes and Development Corp was completing stucco repairs to an existing structure while working on the top section of a two tier tubular welded scaffold system (measured to be 12 feet 8 inches off the ground), which was not fully planked as possible between the front uprights and the guardrail supports.

29 CFR 1926.451(c)(2)(i): Footings were not level, sound, rigid, and capable of supporting the loaded scaffold without settling or displacement:  A). On or about July 1, 2015 an employee of D-Lux Homes and Development was completing stucco repairs to an existing structure while working on a tubular welded scaffold system. The employee had erected the scaffold system on un-even surfaces using broken sections of plaster, 2x4 wood planks, and broken sections of concrete as a mud-sill not in accordance with this section.

29 CFR 1926.1053(b)(4): Ladder(s) were used for purposes other than the purpose for which they were designed:    A). On or about 7/1/2015, Employee was using a 6 foot aluminum A frame folding ladder set atop the top working platform of the scaffold leaning against the wall to gain access to the top of the archway roof structure.  The ladder was too short to accommodate access to the archway roof top, and using it in a folded manner is not the purpose for which the ladder was designed.

29 CFR 1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards.    A). On or About July 1,2015, Mr. Lee an employee of D-Lux Homes and Development was completing stucco repairs to an existing structure while working on a tubular welded scaffold system without any means of fall protection and was exposed to a fall in excess of 10 feet to the floor below. The scaffold was not erected on stable surfaces and not fully planked. Mr. Lee said he was not trained in the proper use of scaffolds or how to recognize the hazards associated with working on scaffolds.
