OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to the hazard of being crushed. a) Worksite - Employee lifting two pieces of granite slab weighing approximately 800lbs each; on or about 7/1/15 without supervision in the warehouse at time of the incident. b) Worksite, - Inspections were not conducted on a 5 ton Yale Global King Electric Wire Rope Hoist; on or about 7/1/15. Note: In addition to abatement certification the employer is required to submit abatement documentation for this item in accordance with 29 CFR 1903.19. Abatement Notes: Among other methods, feasible abatement methods to reduce this hazard include: 1. No slab moved with out supervision 2. Follow the employer, European Granite and Marble Group, Clamp Slab Handling Procedures policy. a) move one slab at a time b) 2 people must move a slab 3. Follow the Operation Manual for the Abaco Cable Lifter: a) no more than one slab should be lifted at any one time

29 CFR 1910.135(a)(1): The employer did not ensure that each affected employee wear a protective helmet when working in areas where there is a potential for injury to the head from falling objects: a) Worksite, 3 Dubon Ct. Farmingdale NY 11735 - Employees were using an overhead crane to lift slabs of stone. The employees were not wearing head protection; on or about 7/1/15. Note: The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.
