29 CFR 1910.132(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, shall be provided, used, and maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact: On or about July 10, 2015, in the facility, an employee required to perform welding (MIG) was exposed to the hazard of skin burn from contact with hot metal and/or sparks. Protective clothing for arms and torso was not provided and used to prevent injury.

29 CFR 1910.132(d)(2): The employer shall verify that the required workplace hazard assessment has been performed through a written certification that identifies the workplace evaluated; the person certifying that the evaluation has been performed; the date(s) of the hazard assessment; and, which identifies the document as a certification of hazard assessment: On or about July 10, 2015, in the facility, employees required to perform metal fabrication operations, including, but not limited to, welding and grinding operations, were exposed to skin and eye hazards necessitating the use of personal protective equipment. The employer did not verify, through a written certification, that the required workplace hazard assessment had been performed.

29 CFR 1910.1200(e)(1): Employers shall develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met: On or about July 10, 2015, in the facility, employees required to perform metal fabrication operations (i.e. welding, grinding) were potentially exposed to metal fume, dust and gases. The employer did not develop, implement, and maintain at the workplace a written hazard communication program which described how the criteria specified in paragraphs (f), (g) and (h) would be met.
