OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by and crushing hazards: a) On or about 7/2/2015, Exterior of building: An employee was operating a Thomas 153 Skid Steer Loader when he was caught and crushed by the loader while retrieving containers from a storage trailer. The employer had not ensured that a seat belt was operational and in use, that the safety bar interlock system was operational, that the back up alarm was operational, that foot control pedals were operational and not sticking, That the parking brake was operational, that employees were not exiting and entering the machine while it was running. Among other feasible and acceptable means of abatement would be to: a) Ensure that the seat belt and safety interlock was operational per the manufacturers Owners manual, section 1.0 b) Ensure that the safety bar interlock was operational per the manufacturers Owners manual, sections 1.0 and 2.3. c) Ensure that employees do not enter and exit the machine while it is running per the manufacturers Owners manual, sections 2.4 and 2.6. d) Ensure that the controls are operational per the manufacturers Owners manual, section 2.10. e) Ensure that the back up alarm and parking brake are operational per the Association of Equipment Manufacturers safety manual, page 11. f) Ensure that employees are provided with training and access to the owners manual per the Association of Equipment Manufacturers safety manual, pages 7 and 10.
