29 CFR 1926.453(b)(2)(v): A body belt with lanyard attached to the boom or basket was not worn by employee(s) working from an aerial lift:   (a) On or about July 1st, 2015, at a construction site located at 9601 E. 63rd Street in Raytown, MO, two employees were observed to be working from a JLG Skytrak aerial lift, over 10 feet above the lower surface, without being tied-off to the boom or basket of the aerial lift.   Abatement certification is required for this Item.  Use the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET for this purpose.  NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM.  FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.760(a)(1):  Each employee engaged in a steel erection activity who is on a walking/working surface with an unprotected side or edge more than 15 feet (4.6 m) above a lower level was not protected from fall hazards by guardrail systems, safety net systems, personal fall arrest systems, positioning device systems, or fall restraint systems:   (a) On or about July 1st, 2015, at a construction site located at 9601 E. 63rd Street in Raytown, MO, an employee was observed to be standing on the top flange of a structural I-beam, over 15 feet above the lower surface, with no type of fall protection system in place or in use.   Abatement certification is required for this Item.  Use the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET for this purpose.  NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM.  FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.761(b): The employer did not train each employee exposed to a fall hazard in accordance with the requirements of 29 CFR 1926.761:   (a) On or about July 1st, 2015, at a construction site located at 9601 E. 63rd Street in Raytown, MO, employees who were exposed to serious fall hazards were performing steel erection work and were not trained in the recognition of fall hazards and the steps required to mitigate those hazards.   Abatement certification is required for this Item.  Use the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET for this purpose.  NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM.  FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
