29 CFR 1903.19(d)(1): The employer must submit to the Agency, along with the information on abatement certification required by paragraph (c)(3) of this section, documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required:   a.  The employer has failed to submit abatement certification and documentation within ten days of the abatement date, September 4, 2015, for a violation of 29 CFR 1926.102(a)(1), issued as citation 1, item 1, and described as follows:      At the southwest side of the worksite where an employee was using a air operated nail gun, the employee was not provided with and required to wear eye protection, thereby exposing the employee to struck-by hazards.  At the northeast side of the worksite where employees were using air operated nail guns, the employees were not provided with and required to wear eye protection, thereby exposing the employee to struck-by hazards.  b.  The employer has failed to submit abatement certification and documentation within ten days of the abatement date, September 4, 2015, for a violation of 29 CFR 1926.501(b)(13), issued as citation 2, item 2, and described as follows:    On the northwest side of building 1, where an employee was unloading sheeting from a forklift, fall protection was not used, thereby exposing the employee to a 30 foot fall hazard.  On the southwest side of building 1, where two employees were sheeting the roof, fall protection was not used, thereby exposing the employee to a 30 foot fall hazard.

29 CFR 1926.102(a)(1): Employees shall be provided with eye and face protection equipment when machines or operations present potential eye or face injury from physical, chemical, or radiation agents.  a. At the south west side of the worksite where an employee was using a air operated nail gun, the employee was not provided with, and required to wear, eye protection, thereby exposing the employees to struck-by hazards.  b. At the north east side of the worksite where employees were using air operated nail guns, the employees were not provided with, and required to wear, eye protection, thereby exposing the employees to struck-by hazards.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.  a. On the north west side of building 1 where an employee was unloading sheeting from a forklift, fall protection was not used, thereby exposing the employee to a 30 foot fall hazard.  b. On the south west side of building 1 where two employees were sheeting the roof, fall protection was not used, thereby exposing the employee to a 30 foot fall hazard.  c. On the north east side of building 3 where two employees were installing roof trusses, fall protection was not used, thereby exposing the employee to a 30 foot fall hazard.  d. On the south east side of building 1 where two employees were installing roof trusses, fall protection was not used, thereby exposing the employee to a 30 foot fall hazard.  Adan Huitron was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 607758, citation number 1, item number 1 and was affirmed as a final order on November 8, 2012, with respect to a workplace located at 5451 Olivia Michal Place, Westerville, OH 43081.
