OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees from 10-12 ft. fall hazard while sitting on the top of a self-supporting step ladder. On or about May 27, 2015, in the Production Area, an employee was exposed to an approximately 10-12 ft. fall hazard while sitting on the top step of a fiberglass self-supporting step ladder to unjam stuck product coming out of the freezer spiral and onto a bend on the siderail of the conveyor leading down to the production lines. Among other methods, one method of feasible abatement would be to use the portable self-supporting ladder as designed, in accordance with ALI/A14.5-2007, Portable Reinforced Plastic Ladders, Section 9.3, Use the portable self-supporting ladder as designed.

29 CFR 1910.147(c)(7)(i)(A): Each authorized employee shall receive training in the recognition of applicable hazardous energy sources, the type and magnitude of the energy available in the workplace, and the methods and means necessary for energy isolation and control. On or about May 15, 2015 and times thereafter, a Treif Machine operator who on a daily basis assembled before production and disassembled a Treif Machine for sanitation purposes after production did not receive authorized employee training to recognize the hazardous energy sources, type and magnitude of energy available, and the methods and means necessary for energy isolation and control.

29 CFR 1910.212(a)(1): Types of guarding. One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. Examples of guarding methods are-barrier guards, two-hand tripping devices, electronic safety devices, etc. a. In the Production Area on the Treif #2 machine, a machine operator's fingers were exposed to an amputation hazard from a 3/4 inch gap between the two metal guards enclosing the blade. b. In the Production Area on the Treif #1 and #2 machines, machine operators were exposed to a amputation hazard while unjamming the swirl roll product by opening the Plexiglas cover on an inadequate machine safeguarding system. Sugar Creek Packing Co. was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA inspection number 916022, citation number 1, item number 1 and was affirmed as a final order on August 14, 2014, with respect to a workplace located at 1241 N. Gettysburg Avenue, Dayton, OH 45417.
