OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees 2 Saints Anns Ave., Bronx NY a) Employer failed to ensure that the excavator operators use the equipment's seat belts; On or about 06-24-2015. Among other methods, a feasible and reasonable abatement method to correct this hazard is to comply with requirements outlined in the "Association of Equipment Manufacturers; Hydraulic Excavator" which provide that: "Fasten the seatbelt, if equipped."
