29 CFR 1926.20(b)(2): Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers. There was no frequent and regular inspection program being maintained in use by a competent person to ensure the jobsite, materials and equipment such as residential apartment framing fall protection devices or systems were being maintained and utilized in a safe condition.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. Located along various areas or the residential apartment structure employees were observed performing roof deck sheeting operations adjacent to the unprotected side or edge of the 6 in 12 roof deck without conventional or alternative fall protection and were exposed in areas to a fall potential in excess of 9'.
