29 CFR 1910.23(a)(2): Ladderway floor opening(s) or platform(s) were not guarded by a standard railing with standard toeboard(s) on all exposed sides (except at the entrance to opening) with passage through the railing either provided with a swinging gate or so offset that a person could walk directly into the opening: The employer does not ensure that all ladderway passages are provided with a swinging gate or are offset to prevent employees from walking off the unguarded area. This violation occurred on or about July 2, 2015, next to the big baler machine where employees were exposed to a fall hazard while working on a platform without having any means to guard the ladderway opening which was directly adjacent to where the employee was working. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that all walking and working surfaces are maintained in accordance with 29 CFR 1910 Subpart D.

29 CFR 1910.23(c)(1): Open-sided floor(s) or platform(s) 4 feet or more above the adjacent floor or ground level were not guarded by standard railings (or the equivalent as specified in 29 CFR 1910.23(e)(3)(i) through (v)), on all open sides: The employer does not guard platforms four feet or more above an adjacent floor or ground level. This violation occurred on or about July 2, 2015, next to the big baler machine where employees were exposed to a fall hazard while working on a platform without guardrails or equivalent protection on all open sides. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees are protected from falling when exposed to falls 4 feet or more above the floor or ground level.

29 CFR 1910.178(l)(2)(ii): The employer did not ensure that each operator had successfully completed the training consisting of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace: The employer does not ensure that employees required to operate forklifts are trained and evaluated to ensure they can operate them safely. This violation occurred on or about July 02, 2015, and at times prior thereto, when employees in the facility were required to operate forklifts while moving material without having been trained and evaluated to ensure they could do so safely. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that they provide the employees training consist of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace.
