29 CFR 1910.178(l)(1)(ii): The employer did not ensure that each operator had successfully completed the training required by paragraph (l), except as permitted by paragraph (l)(5), prior to permitting an employee to operate a powered industrial truck: An employee operating a Genie forklift (GTH-1056 #52777-IBXL) in the construction area on eastside of the new building was exposed to struck-by hazards. The employee was exposed in that he was not trained to avoid striking someone or something.

29 CFR 1926.453(b)(2)(v): A safety harness with lanyard attached to the boom or basket was not worn by employee(s) working from an aerial lift: Employees engaged in installing windows with the use of aerial lift (Blue line Rental #54776-135) were exposed to falls of approximately 30 feet from the basket to the ground below. The employees were exposed in that safety harness with lanyards were not in use.
