29 CFR 1910.23(c)(1): Open-sided floors and/or platforms four feet or more above adjacent floor or ground level were not guarded with standard railings: (a) Dimmer World - Lighting designers conducting lighting operations were exposed to a 25 ft. fall to concrete when accessing the space that had an unguarded open-sided floor, on or about 7/16/2015. (b) Front of House Sound Booth - A lighting designer was conducting lighting operations from an unguarded platform located 10 feet high above the tiled floor, on or about 7/16/2015. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet), in addition, documentation demonstrating the abatement is complete must be included with your certification. This documentation may include, but is not limited to evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1910.95(g)(1): The employer did not establish and maintain an audiometric testing program as provided by 29 CFR 1910.95(g) by making audiometric testing available to all employees whose exposures equal or exceed an 8-hour time-weighted average of 85 decibels: (a) Workplace - A sound engineer conducting sound mixing adjustments during a live concert was exposed to an 8 hour time-weighted average of 90.9 decibels or an equivalent of 113% for an 8 hour time-weighted average. The sound engineer was not enrolled in an audiometric testing program, on or about 8/27/2015. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet), in addition, documentation demonstrating the abatement is complete must be included with your certification. This documentation may include, but is not limited to evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
