29 CFR 1910.95(g)(1): The employer did not establish and maintain an audiometric testing program as provided by 29 CFR 1910.95(g) by making audiometric testing available to all employees whose exposures equal or exceed an 8-hour time-weighted average of 85 decibels: (a) In the production area, on or about July 10, 2015 and at times prior to, an audiometric testing program was not implemented for the employee who was exposed to noise at 149% of the action level (8-hour time-weighted average sound level of 85 dBA) or an equivalent sound level of 87.8 dBA during the 303 minute sampling period, resulting in a noise hazard.
