29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems:  Construction Site: On or about July 13, 2015, and at times prior thereto, two employees were observed applying courses of cement block to a retaining wall without any type of fall protection. This condition exposed the employees to a fall hazard of more than 6-feet to the ground below.

29 CFR 1926.503(c)(3): Inadequacies in an affected employee's knowledge or use of fall protection systems or equipment indicate that the employee has not retained the requisite understanding or skill.  Construction site: On or about July 13, 2015 and at times therein, the employee's lack of knowledge or use of fall protection systems or equipment indicate that the employees have not retained the requisite understanding or skill to enable them to recognize the hazards of falling. This condition exposed the employees to a fall hazard greater than six feet to the ground below.
