29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:  (a) Lot #20 first floor, new townhome construction located at 2710 Avington Lane, Smyrna, GA 30080: Employees were exposed to falls of approximately 11-feet, 11-inches to the lower level while accessing the lower levels and upper levels as the ladder side rails were not extended at least 3-feet past the upper landing surface. The ladder used to access the upper level was 5-feet, 10-inches high and employees had to climb 2x4 cleats to reach the upper level.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:   (a) Front top plate, new townhome construction located at 2710 Avington Lane, Smyrna, GA 30080: Employee was exposed to falls of approximately 24-feet, 3-inches to the lower level while installing 1/2-inch OSB Plywood from a top plate with no fall protection system in place.

29 CFR 1926.1053(b)(4): Ladders were not used for the purpose for which they were designed:  (a) Lot #20 first floor, new townhome construction located at 2710 Avington Lane, Smyrna, GA 30080: The employer exposed employees to fall hazards of approximately 5-feet, 10-inches while using a self-supporting ladder to access and egress from upper levels of the residence. The Werner Step Ladder (Model - FS206) which had not been opened and locked into position, was being used in a manner and for a purpose other than what it was designed.   Rubio Framing, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.1053(b)(4), which was contained in OSHA inspection number 899779, citation number 1, item number 2 and was affirmed as a final order on 05/29/2013, with respect to a workplace located at 3025 Eagle Ridge, Roswell, GA 30076.
