29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:    The employer does not protect employees from head injuries in areas where there is a possible danger of head injury from impact, or falling or flying objects. This violation was observed on or about July 14, 2015, at or near 5600 W. Davis St. in Conroe, TX, where employees in an excavation were exposed to struck-by hazards when installing concrete formwork without head protective helmets.     Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees working in areas where there is a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, are protected by protective helmets.

29 CFR 1926.651(h)(1): Employees were working in excavations in which there was accumulated water, or excavations in which water was accumulating, and adequate precautions had not been taken to protect employees against the hazards posed by water accumulation.    The employer does not protect employees in excavations in which water has accumulated or accumulating. This violation was observed on or about July 14, 2015, where two employees were exposed to a struck-by hazard when installing concrete formwork in an excavation with accumulated water without adequate precautions to protect the employees from hazards posed by water accumulation.    Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees working in excavations in which there is accumulated water, or excavations in which water is accumulating, that adequate precautions are taken to protect employees against the hazards posed by water accumulation.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c).     The employer does not ensure that each employee in an excavation is protected from cave-ins. This violation was observed on or about July 14, 2015, where two employees were exposed to a struck-by hazards when installing concrete formwork in an excavation with an approximately 9 foot wall without being protected from cave-ins by an adequate protective system.    Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that each employee in an excavation is protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c).
