29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by rotating parts: (a) Cocoa Room - The employer did not ensure that the top guard on the 1000 pound mixer was interlocked or permanently attached to protect employees from coming in contact with rotating parts. (b) Cocoa Room - The employer did not ensure that the 1000 pound mixer was equipped with fingers guards to protect employees from rotating parts located underneath the mixer. On July 13, 2015, an employee suffered an amputation injury to his left fingers when he came in contact with rotating blades located underneath the mixer. In accordance with the requirements of 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete and must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase, or repair of the equipment, photographic or video evidence of abatement, or other written records.
