OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being thrown from or pinned under, or crushed by a forklift by not wearing a seat belt. (a) In and around the steel building being constructed at 671 N. Yellowstone Hwy, Rigby, Idaho, on or about July 14, 2015, female employee operating the Sky Trak material handler was observed not wearing the seat belt and was not required to wear a seat belt. Note: Abatement certification is required for this item.

29 CFR 1926.760(a)(1): Each employee engaged in a steel erection activity who is on a walking/working surface with an unprotected side or edge more than 15 feet (4.6 m) above a lower level is not protected from fall hazards by guardrail systems, safety net systems, personal fall arrest systems, positioning device systems, or fall restraint systems. (a) The Employer does not ensure its workers are protected from serious fall hazards during construction activities. This violation was most recently observed at the construction of an engineered steel structure at 671 N. Yellowstone Hwy, Rigby, Idaho, on July 14, 2015. Employees were observed working at the peak of the roof without fall protection. The potential fall height from the peak was approximate 21 feet to gravel and materials storage below. There is no fall protection plan to deal with fall hazards and working near unprotected edges. Hansen Steel Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard, 29 CFR 1926.760(a)(1), which was contained in OSHA inspection number 1021115, citation number 1, item number 1a and was affirmed as a final order on 03/19/2015, with respect to a workplace located at 366 Dividend Drive, Rexburg, Idaho 83440.
