29 CFR 1904.39(a)(2): The employer did not report an in-patient hospitalization, amputation, or loss of an eye as a result of a work-related incident to OSHA within twenty-four (24) hours: The employer did not report all hospitalizations incidents to OSHA within twenty-four (24) hours. This violation occurred on or about May 2, 2015 at the Walmart Store #26, where an employee fell to the concrete floor from a ladder while retrieving end cap shelving from an upper storage rack at the back aisle way leading to the dairy cooler. The Walmart Store #744 was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1904.39(a)(2), which was contained in OSHA inspection number 1059076, citation number 2, item number 1 and was affirmed as a final order on August 31, 2015, with respect to a workplace located at 6626 FM 1960 Road, Humble Texas.
