29 CFR 1910.1000(a)(2): Employee(s) were exposed to an airborne concentration of Copper Fume listed in Table Z-1 in excess of the 8-hour Time Weighted Average (TWA) concentration of .1 mg per cubic meter for that contaminant: a) Effort Foundry - An employee, Arcer, was exposed to an 8 hr. TWA of .22 mg per cubic meter of Copper Fume. This level is 2.18 times the permissible exposure limit (PEL) of .1 mg per cubic meter. This exposure occurred over a 225 minute sampling period and a zero exposure was assumed for the 255 minutes not sampled to complete the 480 minutes of an 8-hour TWA. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states that employees and their representatives were informed of this abatement.

29 CFR 1910.1000(e): Feasible administrative or engineering controls were not determined and implemented to achieve compliance with the limits prescribed in 29 CFR 1910.1000(a) through (d): a) Effort Foundry - An employee, Arcer, was exposed to an 8 hr. TWA of .22 mg per cubic meter of Copper Fume. This level is 2.18 times the permissible exposure limit (PEL) of .1 mg per cubic meter, and the employer did not determine or implement feasible administrative or engineering controls to achieve compliance with the PEL. This exposure occurred over a 225 minute sampling period and a zero exposure was assumed for the 255 minutes not sampled to complete the 480 minutes of an 8-hour TWA. Feasible abatement methods include but are not limited to: 1) substitution with less toxic materials. 2) Administratively reduce time employees work at task with high exposure. 3) Redesign of hood and ventilation rated to increase fume capture.
