OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing for likely to cause death or serious physical harm to employees in that employees were exposed to burns to the eyes from hazardous material such as but not limited to silica or lime: a.) Chemical Building 2: Employees were dispensing and mixing corrosive chemicals such as hydrochloric acid and were exposed to eye irritations, redness, or irreversible corneal damage. b.) Boiler Room 1&2: Employees were replacing and reconnecting corrosive water treatment chemicals such as BWT 410 and were exposed to eye irritations, redness, or irreversible corneal damage. The employer did not ensure the emergency eye wash/shower station was maintained in accordance to ANSI Z358.1, 2009. The emergency eyewash station presented the following conditions: a. Emergency eyewash/shower station was not activated weekly to ensure operability and availability of water b. Emergency eyewash/shower station was not inspected annually

29 CFR 1910.1200(f)(5)(ii): The employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the appropriate hazard warnings: a.) Boiler Room 1&2: The employees were exposed to chemical hazards when the employer permitted the employee to insert and extract a hose into a 500 gallon of hazardous material such as but not limited to BWT 410, a corrosive material, that was not labeled with the appropriate hazard warnings. b.) Chemical Bldg. 2: The employees were exposed to chemical hazards when the employer permitted the employees to insert or extract a hose from a 500 gallon of hazardous material such as but not limited to Versa TL container that was not labeled with the appropriate hazard warnings.
