29 CFR 1910.1048(h)(1)(i): All contact of the eyes and skin with liquids containing 1 percent or more formaldehyde was not prevented by the use of chemical protective clothing made of material impervious to formaldehyde and the use of other personal protective equipment such as goggles and face shields, as appropriate to the operation: a) In the Histology Lab, on or about July 16, 2015 - Histology Technicians wear SP Lab Coats made from three-layer SMS fabric that isn't impervious while embedding, cutting and dumping tissues in 10% Neutral Buffered Formalin (3.5 - 4% formaldehyde). b) In the Histology Lab, on or about July 16, 2015 - A pathologist grossing samples in 10% Neutral Buffered Formalin (3.5 - 4% formaldehyde) was wearing a SP Lab Coat made from three-layer SMS fabric that isn't impervious.

29 CFR 1910.1048(j)(3): The employer did not ensure that all leaks were repaired and spills were cleaned promptly by employees wearing suitable protective equipment and trained in proper methods for cleanup and decontamination: a) In the Histology Lab, on or about July 8, 2015 - Surgical specimens preserved in 10% Neutral Buffered Formalin (3.5-4% formaldehyde) were stored on shelves which collapsed spilling their contents on the counter and floor of the Histology Lab. Employees cleaned the spill wearing a SP Lab Coat which was not impervious. b) In the Histology Lab, on or about July 8, 2015 - Surgical specimens preserved in 10% Neutral Buffered Formalin (3.5-4% formaldehyde) were stored on shelves which collapsed spilling their contents on the counter and floor of the Histology Lab. Employees cleaned the spill wearing a 3M N95 particulate respirator and a full-face air purifying respirator equipped with P100 particulate filter.

29 CFR 1910.1048(j)(4): Formaldehyde-contaminated waste and debris resulting from leaks or spills was not placed for disposal in sealed containers bearing a label warning of formaldehyde's presence and of the hazards associated with formaldehyde: a) In the Histology Lab, on or about July 8, 2015 - Specimens preserved with 10% Neutral Buffered Formalin and sorbent pads, personal protective equipment and street clothes all contaminated with 10% Neutral Buffered Formalin were disposed in containers which did not bear a label warning of formaldehyde's presence.
