29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or (c): a) On or about July 14, 2015, employees were exposed to cave-ins while they worked in an excavation which was not protected from cave-ins by an adequate protective system. Employees worked in an excavation which was approximately 15 feet deep. The excavation had straight cut walls with an inadequate shielding system (trench box) that was too small for the depth of the excavation.

29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary: a) On or about July 14, 2015, were exposed to injuries from falling excavated materials while working in a trench. The materials excavated from a 15 feet deep trench were piled at the edge of the trench and were not moved at least 2 feet from the edge.

29 CFR 1926.651(k)(2): Where a competent person found evidence of a situation that could result in a possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employees were not removed from the hazardous area until the necessary precautions were taken to ensure their safety: a) On or about July 14, 2015, and at times prior, employees were exposed to cave-in hazards because the employer did not ensure that employees did not enter a trench after the competent person observed evidence of potential cave-in conditions.
