OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees. On or about July 12, 2015 and at times prior there to, the employer did not ensure that employees operating a Polaris Ranger 4 seat all-terrain vehicle (ATV) on rough, sloped, uneven terrain were in use of seat belts and a protective helmet while operating the ATV. Employees were exposed to the hazard of rollover and/or struck by hazards while operating the ATV.
