OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that they were exposed to a fall hazard when standing on a pallet elevated by a forklift with no fall protection. a. In the warehouse, an employee was standing on a pallet that was elevated approximately 8 feet by a forklift to access product that had fallen over. The pallet was not secured to the forklift and the employee was not provided with fall protection.
