29 CFR 1926.100(a): Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, were not protected by protective helmets. On or about July 15, 2015, an employee working below an area where work was being conducted was not in use of a protective helmet exposing the employee to a struck-by hazard.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used. Cross braces were used as a means of access. On or about July 15, 2015 and at times prior thereto, the employer did not provide a safe means to access and exit a scaffold. The employees were observed climbing the crossbraces and end frames to access and exit the scaffold, exposing the employees to a fall hazard.
