29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system:    The employer fails to assure effective fall protection measures as required by the standard, as demonstrated in the following instances:     a.   On the southeast side of the structure, an employee working for L & J Cleaning & Construction Services, Inc. installing framing materials to a rafter are not protected from a 25 feet fall hazard by the use of a personal fall arrest system.      b.   On the south side of the structure, an employee working for Fast Solutions Company, Inc. building permanent rails for a balcony are not protected from a 12 feet 5 inch fall hazard by the use of a personal fall arrest system.      c.   On the south side of the structure, an employee working for Heritage and Son Company, Inc. building permanent rails for a balcony are not protected from a 11 feet 7 inch fall hazard by the use of a personal fall arrest system.    D.R. Horton, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1070789, citation number 01, item number 01 which was affirmed as a final order on July 1, 2015, with respect to a workplace located at 823 Marrow St., Austin, TX 78757. 29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):     The employer fails to assure effective fall protection measures as required by the standard, as demonstrated in the following instances:    a. On or about July 9, 2015 on the south side of the structure, an employees of respondent D.R. Horton, Inc. assisting in the building temporary rails for a balcony are not protected from a 11 feet 7 inch fall hazard by the use of a personal fall arrest system.

29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  a.  On or about July 8, 2015, on the south side of a new construction residential apartment, employees working beneath an employee installing railings for Fast Solutions Company, Inc. on a balcony was not wearing hard hats, exposing employees to the hazard of being struck by falling debris.   b.  On or about July 9, 2015, on the south side of a new construction residential apartment, employees working beneath an employee installing railings for Fast Solutions Company, Inc. on a balcony was not wearing hard hats, exposing employees to the hazard of being struck by falling debris.

29 CFR 1926.451(g)(1)(i): Each employee on a boatswains' chair, catenary scaffold, float scaffold, needle beam scaffold, or ladder jack scaffold was not protected by a personal fall arrest system:  a.  On or about July 8, 2015, on north side of a new residential construction apartment, an employee of Fastway Solutions Company, LLC was working from a ladder jack was not protected from a 16 feet 2 inch fall hazard by the use of a personal fall arrest system.  b.  On or about July 9, 2015, on east side of a new residential construction apartment, an employee of Fastway Solutions Company, LLC was working from a ladder jack was not protected from a 22 feet 5 inch fall hazard by the use of a personal fall arrest system.  c.  On or about July 9, 2015, on east side of a new residential construction apartment, an employee of Fastway Solutions Company, LLC was working from a ladder jack was not protected from a 14 feet fall hazard by the use of a personal fall arrest system.
