29 CFR 1917.45(g)(4)(ii)(B): The crane shall be secured against travel, using all available means of securing. At the time of the accident of 5-2-2015, the excavator being used as a crane to unload a barge was not secured to prevent travel. The position of the excavator had moved toward the barge during operation causing the distance between the excavator and the barge to decrease creating a pinch point where an employee was injured.

29 CFR 1917.45(i)(2): Accessible areas within the swing radius of the body of a revolving crane were not physically guarded during operations to prevent an employee from being caught between the body of the crane and any fixed structure or between parts of the crane; At the time of the accident on 5-2-2015, the swing radius of the Excavator was not guarded. The excavator was acting as a crane to unload a fertilizer barge and an employee was struck and pinned between the body of the crane and the coaming of the fertilizer barge.
