29 CFR 1910.146(k)(1)(i):  An employer who designated rescue and emergency services, pursuant to paragraph (d)(9) of this section, did not evaluate a prospective rescuer's ability to respond to a rescue summons in a timely manner, considering the hazard(s) identified:    a)  Everson Tesla VPI Pit - On or about July 16, 2015 employees enter a VPI pit area that is approximately 8 feet deep to drain toluene containing resin from the VPI tanks and to clean the pit floor using toluene.  The employer did not evaluate a prospective rescuer's ability to respond to a rescue summons in a timely manner, considering the hazard(s) identified.    b) Everson Tesla - VPI Tank - On or about July 28, 2015,  employees enter a VPI processing tank that is approximately 7.5 feet deep to hookup and disconnect internal resin piping and when cleaning is required. The employer did not evaluate a prospective rescuer's ability to respond to a rescue summons in a timely manner, considering the hazard(s) identified.    Abatement certification required within 10 days after abatement date.  The certification shall include a statement that abatement is complete, date and method of abatement, and states that employees and their representatives were informed of this abatement.
