29 CFR 1910.27(c)(4):   The employer did not install a fixed ladder so that the nearest permanent object in back of the ladder shall be not less than 7 inches, except when unavoidable obstructions are encountered, the ladder shall be installed with clearances as shown in figure D-3.  From figure D-3, the employer did not install the fixed ladder so that there was at least a 4 1/2 inch minimum vertical clearance between the obstruction and the rung just beneath the obstruction:  At the Worksite:  a)  70 Hudson Street, At the Top of the Fixed Ladder, Hoboken, NJ.  Employees were exposed to falls of 10 feet to the basement below as the top rail of the fixed ladder only had a 1 inch vertical distance between the rail and the wood obstruction behind it which would cause one to lose their footing or to get their foot stuck in the small space.
