29 CFR 1910.23(c)(1): Open-sided floors and/or platforms four feet or more above adjacent floor or ground level were not guarded with standard railings (or equivalent) and toeboards. Note: Toeboards are only required, wherever, beneath the open side; persons can pass, there is moving equipment or there is equipment with which falling materials could create a hazard: 330 North King St, Northampton MA On July 21, 2015 and at times prior, employees walked on top of the open-sided dairy cooler to place, inventory, and to retrieve stored items. The open sided area was 7 feet 9 inches off the floor and was not guarded with a standard guardrail(or equivalent).
