OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the inhalation hazard of carbon monoxide from a machine with a clogged filter: (a) On July 20, 2015, employees were exposed to carbon monoxide from a National 7600 High Speed Propane Ride On Rip Up Machine, Serial No. 7600-2037 while removing floor adhesive at 2000 Central Ave., Suite 300A, Kansas City, MO 64108. Among other methods, one feasible and acceptable means of abatement would be the following: 1. Ensure that the 7600 Propane Powered Ride-On, Instruction Manual, Section on Rules For Safe Operation states: Proper ventilation; when engines operate in enclosed spaces such as buildings under construction carbon monoxide can accumulate and reach concentrations that are dangerous for humans. The concentration of CO in the building when the first readings were taken by EMS were approximately 1300 ppm, (immediately dangerous to life or health (IDLH) is 1200). 2. Ensure that the 7600 Propane Powered Ride-On Instruction Manual, Section on Rules For Safe Operation states: A carbon monoxide monitor is recommended for the operator to wear and anyone working in the vicinity. Failure to do so could cause bodily injury and/or death. The use of detectors helps to verify if the work area is safe from Carbon Monoxide poisoning. 3. Ensure that the 7600 Propane Powered Ride-On, Instruction Manual, Section on Machine Maintenance states: Daily inspection list for damage and defects at least once during every working shift. Starting and stopping procedures must be followed in accordance with the Operating Instructions. Daily maintenance and inspection checklist followed and conducted before each use.

29 CFR 1926.55(a): Employee(s) were exposed to material(s) at concentrations above those specified in the Threshold Limit Values of Airborne Contaminants for 1970 of the American Conference of Governmental Industrial Hygienists: July 20, 2015 from 0830 - 1130 employees were exposed to carbon monoxide from a high speed propane ride on rip up machine made by National. The employer failed to provide a safe and healthy work environment free of hazards associated with carbon monoxide levels: 1. A laborer was exposed to 611.0 parts per million (ppm) carbon monoxide level of air as determined by the employee's Carboxyhemoglobin (%COHb) which was 43.2% medical blood gas measurement following the employee's exposures to Carbon Monoxide. The 8 hour TWA exposure was 285.1 ppm CO (Sampling and Analytical Error SAE = 0.173), which is 5.70 times the OSHA PEL of 50 ppm CO.

The employer failed to provide a safe and healthy work environment free of hazards associated with carbon monoxide with the use of adequate ventilation in the office space. 1. A laborer was exposed to 611.0 parts per million (ppm) carbon monoxide level of air as determined by the employee's Carboxyhemoglobin (%COHb) which was 43.2% medical blood gas measurement following the employee's exposures to Carbon Monoxide.
