29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees. The employer does not provide a means of egress in trench excavations . This violation was observed on or about July 23, 2015, at the excavation site where employees were exposed to falls when entering and exiting an excavation without a means of egress. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees are protected from falls when entering and exiting excavations.

29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary The employer does not ensure that protection was provided by placing materials at least 2 feet from the edge of excavations. a) This violation was observed on or about July 23, 2015 at the excavation site where employees were exposed to a struck-by or crushed-by hazard when working in an excavation that had a Case excavator operating less than 2 feet from the edge of the excavation. b) This violation was observed on or about July 23, 2015, at the excavation site where employees were exposed to struck-by or crushed-by hazard when working in an excavation that had the excavated spoil pile placed less than 2 feet from the edge of the excavation. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps to ensure that employees are protected from equipment or other materials from falling or rolling into the excavation.
