29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards are present, and/ or are likely to be present, which shall necessitate the use of personal protective equipment (PPE): a) 1130 Riverdale St., West Springfield, MA: On or about July 22, 2015, the employer failed to assess the workplace for hazards present when servicing HVAC units located on the roof of a company building(s) that posed fall hazards which necessitates the use of personal protective equipment such as a personal fall arrest system or similar means to keep employees from falling off the roof.

29 CFR 1910.132(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, and/or maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact: a) 1130 Riverdale St., West Springfield, MA: On or about July 22, 2015, an employee was servicing the HVAC unit located on the roof of a company building more than 10 feet above the ground below without any protective equipment to keep that employee from falling off said roof. F.L. Roberts & Company was previously cited for a violation of an equivalent standard 29 CFR 1926 501 (b) (1) which was contained in OSHA inspection number 911384, citation number 1 item number 1 and was affirmed as a final order on August 13,, 2013, with respect to a workplace located at 833 E. Columbus Ave., Springfield.
