Jobsite at right rear of parking lot behind Burlington Coat Factory:  Employees working in an excavation were not protected from falling rocks and dirt where the excavated material was placed at the edge of the excavation and not restrained.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or 29 CFR 1926.652(c).     Jobsite at right rear of parking lot behind Burlington Coat Factory:  Employees were replacing a catch basin in an excavation that was approximately eight (8) feet deep that was not benched or shored.

29 CFR 1926.1053(b)(1): Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder.      Jobsite at right rear of parking lot behind Burlington Coat Factory: Employees working in an excavation were utilizing a folded eight (8) foot stepladder to access the work.  The ladder did not extend above the ground and was not secured from movement.

29 CFR 1926.1053(b)(4): Ladder(s) were used for purposes other than the purpose for which they were designed:    Jobsite at right rear of parking lot behind Burlington Coat Factory: Employees were using an eight (8) foot stepladder in the folded position to access the bottom of an excavation.  The ladder was folded and leaning against the excavation wall and almost vertical.
