OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck-by hazard: a) Near the GC's job trailer: On or about July 22, 2015, an employee was exposed to a struck-by hazard, while operating a Case Loader Backhoe, Model # 580N, while not utilizing/wearing the manufacturer provided and required seatbelt. b) Near the GC's job trailer: On or about July 22, 2015, an employee was exposed to a struck-by hazard, while operating a Case Loader Backhoe, Model # 580N, while the seatbelt was defective, in that it did not fully retract.
