OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falls and struck-by hazards while working from a platform mounted on the back of a moving vehicle: On or about July 24, 2015, the employer failed to ensure employees tasked with picking up traffic cones while sitting on a platform that was mounted on the rear of a moving paint commercial motor vehicle were protected from fall and struck by hazards by an adequate guardrail system.
