29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval:    The employer is failing to protect employees from struck by hazards associated with operating a forklift when using modified attachments.  The most recent occurrence of this took place at the facility located at 12021 Roberts Road, LaVista, NE where the employer had employees using Vestil Manufactured forklift extenders to lift longer pallets within their facility and an employee had a portion of his finger amputated while trying to separate the attachments from the forks.  Instances of alteration violations include but are not limited to:   i.      The steel straps welding along the outer edges of the attachments in effort to reinforce the lengthy extensions which.     ii.     The length of the attachments must not exceed 50% of the length of the fork as outlined in ANSI/ITSDF B56.1-2009, Section 7.39.2.  These attachments were 96 inches long and the forks on the truck are 44 inches long.

29 CFR 1910.178(a)(5): The powered industrial truck was equipped with front-end attachments other than factory installed attachments, however the employer did not request that the truck be marked to identify the attachments and show the approximate weight of the truck and attachment combination at maximum elevation with load laterally centered:    The employer is failing to protect employees from struck by hazards associated with operating a forklift when using attachments.  The most recent occurrence of this took place at the facility located at 12021 Roberts Road, LaVista, NE where the employer had employees using Vestil Manufactured forklift extenders to lift longer pallets within their facility without having updated the data plate for the Hyster 50 model S50FT forklift in which the data plate identifies the change in maximum weight capacity and other restrictions.

29 CFR 1910.178(l)(3)(i)(G): Powered industrial truck operators did not receive initial training on fork and attachment adaptation, operation, and use limitations;    The employer is failing to provide employees with training on the proper use and limitations of the extender attachments the employees use to pick up longer pallets.  The most recent occurrence of this took place at the facility located at 12021 Roberts Road, LaVista, NE where the employer has inadequately trained employees using Vestil Manufactured forklift extenders to lift longer pallets within their facility without having conducted specialized training that addresses the issues associated with using attachments.  Issues include but are not limited to:  i.      The change in weight capacity dependent on the height of the lift.    ii.     The length of the attachments must not exceed 50% of the length of the fork as outlined in ANSI/ITSDF B56.1-2009, Section 7.39.2.  These attachments were 96 inches long and the forks on the truck are 44 inches long.   iii.    The center load tipping point as it relates in the stability triangle, outlined in Appendix A of this subpart.

29 CFR 1904.39(a)(2): Basic Requirement. Within twenty-four (24) hours after the in-patient hospitalization of one or more employees or an employee's amputation or an employee's loss of an eye, as a result of a work-related incident, you must report the in-patient hospitalization, amputation, or loss of an eye to OSHA.    The employer has failed to report a workplace incident resulting in the amputation of an employees finger.  The most recent occurrence of this took place at the facility located at 12021 Roberts Road, LaVista, NE where the employer had an employee injured on Jun 30, 2015 while removing the Vestil Manufactured forklift extenders from the forks of the Hyster Model 50 resulting in an amputation to the first joint of the left index finger; the employer reported the incident to OSHA on Jul 24, 2015.

The most recent occurrence of this took place at the facility located at 12021 Roberts Road, LaVista, NE where the employer has employees operating forklifts and using Vestil Manufactured forklift extenders to lift longer pallets without having conducted any hazard assessments to determine if there are any requirements for personal protective equipment or is there a need to select a specific sized extension for the task they are performing.
