Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to explosion hazards when cutting into an unpurged compressed gas cylinder: In the scrap area; The employee was operating a shear attachment on a CAT Excavator to cut into an unpurged accumulator with a charged gas bladder containing nitrogen at approximately 2175 psi, exposing the employees to struck by hazards from gas cylinder explosion. ONE FEASIBLE AND ACCEPTABLE MEANS OF ABATEMENT WOULD BE TO: Follow the Handbook of Compressed Gases of the Compressed Gas Association, Inc. CGA P-9 1992, The Inert Gases: Argon, Nitrogen and Helium Chapter 7.

29 CFR 1910.110(f)(2)(i): Containers in storage were not located so as to minimize exposure to excessive temperature rise, physical damage, or tampering from unauthorized persons:      Perlman Recycling, 54 South Merriam Street, Pittsfield, Massachusetts; On or about July 27, 2015 liquid petroleum gas tanks that had been purchased as scrap were not stored in a suitable enclosure or protected against tampering.  Tanks with and without valves were observed in scrap piles, loose in the "yard", and stored in a cardboard - Gaylord.

29 CFR 1910.151(c): Where employees were exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes and body were not provided within the work area for immediate emergency use:    Employee break room, Perlman Recycling, 54 South Merriam Street, Pittsfield, Massachusetts;  The employer did not provide an eyewash that provided a minimum of 15 minutes continuous flow for employees who handle vehicle and marine batteries and were exposed to battery electrolyte.

29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:    Workshop, Perlman Recycling, 54 South Merriam Street, Pittsfield, Massachusetts; Employees were exposed to amputation hazards while using an alligator shear that was not properly guarded.

29 CFR 1910.303(b)(2): Listed or labeled electrical equipment was not used or installed in accordance with instructions included in the listing or labeling:    Administrative office break room, Perlman Recycling, 54 South Merriam Street, Pittsfield, Massachusetts; The employer used a relocatable power tap to supply electrical energy to a high current draw piece of equipment.  In particular the relocatable power tap was used to power the refrigerator in the break room which violates the listing and labeling of the power tap.

29 CFR 1910.303(e)(1)(ii): Electric equipment shall not be used unless markings have been placed on equipment such as voltage, current, wattage and other ratings as necessary:    Workshop electric panels, Perlman Recycling, 54 South Merriam Street, Pittsfield, Massachusetts; Wall hung distribution panels did not have any markings to indicate voltage, current, or manufacturer information as required to determine safe work practices required to operate overcurrent devices or perform maintenance on the equipment.
