29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  On or about July 28, 2015, at the worksite located at 5261-5301 Royalwood Rd. Cleveland Ohio 44133, the employer failed to ensure that employees were protected from overhead hazards by providing and requiring the use of protective helmets. An employee working on a lower level was exposed to overhead hazards from the work activities taking place above.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  On or about July 28, 2015, with respect to a worksite located at 5261-5301 Royalwood Road Cleveland Ohio 44133, the employer failed to ensure that employees were provided effective fall protection while performing construction of a second and third story balcony. The balcony measured approximately 17.8 feet to the ground below.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:  On or about July 28, 2015, with respect to a worksite located at 5261-5301 Royalwood Road Cleveland, Ohio 44133, the employer failed to provide employees with a ladder that extended three feet above the upper balcony work level.
