29 CFR 1910.303(b)(7)(i): Unused openings in boxes, raceways, auxiliary gutters, cabinets, equipment cases, or housings shall be effectively closed to afford protection substantially equivalent to the wall of the equipment. a) On or about July 28, 2015- job site at 1 Beach 193rd Street, Rockaway Point, NY 11697 the employer permitted employees to operate two outdoor pool water pumps that are powered by conductors enclosed in a metal raceway that is not effectively closed. WRITTEN ABATEMENT CERTIFICATION IS REQUIRED.

29 CFR 1910.304(b)(3)(ii)(C)(3): Each cord set, attachment cap, plug, and receptacle of cord sets, and any equipment connected by cord and plug, except cord sets and receptacles which are fixed and not exposed to damage, shall be visually inspected before each day's use for external defects, such as deformed or missing pins or insulation damage, and for indications of possible internal damage. Equipment found damaged or defective shall not be used until repaired: a) On or about July 28, 2015- job site at 1 Beach 193rd Street, Rockaway Point, NY 11697 the employer permitted employees to operate an electrically powered pool vacuum pump that had damage to the cover and plug of its flexible power cord. WRITTEN ABATEMENT CERTIFICATION IS REQUIRED.
