OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees exposed to a fall hazard while standing on the forks of the forklift.     On or about July 27, 2015, in the Warehouse, a forklift operator was operating a Hyster sit-down forklift and raised an employee who stood on the forks of the forklift next to a couch while sliding the couch off the forks and onto the 2nd level shelving and was exposed to a 8 ft. fall hazard.    Among other methods, one method of feasible abatement would be to construct a pallet matching the size of the couch can be stored on and then using a forklift to lift the pallet with the couch onto the metal shelving unit.

29 CFR 1910.178(l)(2)(ii): Training shall consist of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace.    Practical exercises and an evaluation of an operator's performance in the workplace during powered industrial truck training conducted by a third party, Miami Industrial Trucks, did not reflect the actual tasks required to be performed by powered industrial truck operators at Lewis & Michael, Inc. in the warehouse and yard.
