29 CFR 1926.21(b)(6)(i): Employees required to enter into confined or enclosed spaces were not instructed as to the nature of the hazards involved, the necessary precautions to be taken, and in the use of protective and emergency equipment required: a. On or about July 28, 2015 and at times prior, an employee was exposed to serious health hazards such as asphyxiation or death while working inside a newly installed main water manhole. The employee was not provided with training associated with the hazards of confined spaces.

29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees: a. On or about July 28, 2015 and at times prior, employees were exposed to serious injuries due to no egress access in the event of an emergency. The employees working inside the trench were not provided with a stairway, ladder, or other safe means of egress and had to crawl out of the trench.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c): a) On or about July 28, 2015 and at times prior, employees were not protected from cave-in hazards while installing water main pipes in an unprotected trench. The trench was approximately 5 feet wide, had vertical walls ranging from 7 to 10 feet in depth in several areas where employees were working. Gordon Construction Co., Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652(a)(1) which was contained in OSHA inspection number 452296, citation number 2, item number 1 and was affirmed as a final order on 08/06/2012, with respect to a workplace located at Broadview Terraces, Colorado Springs, CO 80906.
