29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:    a)  MWBD Traffic Control, LLC at Mile Marker 141, US Hwy 71, Last Chance, CO 80757:  On or before July 23rd, 2015, the employer did not ensure that all flaggers had been properly trained and/or certified.  Flaggers allowed several vehicles to enter into the work zone without a pilot vehicle escort.  This condition exposed employees in the work zone to struck-by hazards from motorists.      Abatement Note: Among other methods, one feasible and acceptable abatement method to correct this hazard is to ensure proper use and training of flaggers. This abatement method is described in the Manual on Uniform Traffic Control Devices (MUTCD), Millennium Edition, Chapter 6E.  The MUTCD on page 6E-1 says "Because they are responsible for road user safety, and because they make frequent contact with the public, flaggers should have the following minimum qualifications:" As listed subparagraph "B. Adequate training in safe temporary traffic control practices;".

29 CFR 1926.200(g)(2): Traffic control signs or devices used for protection of construction workers did not conform to Part VI of the Manual of Uniform Traffic Control Devices (AMUTCD"), 1988 Edition, Revision 3, September 3, 1993, FHWA-SA-94-027 or Part VI of the Manual on Uniform Traffic Control Devices, Millenium Edition, December 2000, FHWA, which are incorporated by reference:     a)  MWBD Traffic Control, LLC at Mile Marker 141, US Hwy 71, Last Chance, CO 80757:  On or before July 23rd, 2015, the employer did not ensure that an existing permanent regulatory device indicating a speed limit of 65 mph had been covered or removed when different regulatory measures had been implemented onsite.  This condition exposed employees working in and along the roadway to struck-by hazards.      Abatement Note:  Among other methods, one feasible and acceptable abatement method to correct this hazard is to ensure that permanent regulatory devices are either removed or appropriately covered to ensure that motorists adhere to the appropriate regulatory devices.
